FDA-Approved Label vs. Off-Label: What Does It Mean?

34790757 - wrinkle reduction, the lion

If you’ve done research online for certain MedSpa or cosmetic procedures, you might have stumbled across the term “off-label.” In the US, prescription drugs require an FDA approval to be prescribed to patients, but these drugs are often prescribed for uses outside of the FDA approval guidelines for that drug—that’s where the term “off-label” comes from. Per WebMD, “Off-label” means the medication is being used in a manner not specified in the FDA’s approved packaging label, or insert.”

Why does the FDA allow off-label use?

After the FDA approves a drug—which is an extensive process where the FDA evaluates the safety, effectiveness, and indication for a drug—healthcare providers can generally prescribe the drug for an “off-label” use if they come to the determination that it is medically appropriate for a particular patient. A practitioner might choose to take such an approach if all other prescriptions have failed or if the patient would benefit from the off-label use, as is the case with many cosmetic and aesthetic procedures.

What cosmetic treatments are considered FDA approved vs. “off-label?”

Botox is FDA approved for the crows feet and glabella area (the area between the eyes) to reduce the appearance of fine lines and wrinkles. However, Botox is often used in the forehead, nose, lip, jaw, chin, and underarm areas, as well, meaning these are “off-label” uses for the prescription.

Likewise, some fillers, such as Juvederm, Voluma, and Restylane, are FDA approved for use in the nasal labial folds, lips, and cheeks, but are also used in the chin, bridge of the nose, and under the eyes.

What do I need to consider if a practitioner uses “off-label” practices?

Many MedSpas and clinics offering cosmetic services will apply treatments and prescriptions for both their FDA-approved and “off-label” uses. Doing so serves the client by offering the benefits of a prescription, such as Botox or fillers, to fully meet the patient’s goals. What you want to be sure of is that you’re working with a reputable provider that knows what they’re doing and has conducted several of the procedures you’ve been prescribed. Read more about selecting a reputable provider by reviewing “What to Look for in a Reputable MedSpa and Cosmetic Services Establishments.”

DermaTouch RN just celebrated their 10 year anniversary and plan to be around for several more decades to come. Contact us today to determine the best approach to meet all of your skin care and cosmetic needs and to better understand “off-label” utilization!

Unlike Other MedSpas, DermaTouch RN Passes the Savings on to The Client!

If you look at the prices at many MedSpas and Aesthetic service providers, they are definitely not for those on a budget. For many, cosmetic procedures are considered luxury services that very few can afford. But that’s not the case with DermaTouch RN.

Legal vs. Illegal Practices – Do You Know Who is Injecting You?

When you enter a MedSpa or cosmetic service provider’s office, you expect to receive treatment from a professional, licensed individual who knows what he or she is doing. Unfortunately, this isn’t always the case. With the increase in “17032306 - legal vs illegal illustration design over a blackboardspa” parties, medispas, and other establishments boasting to offer cosmetic services such as Botox and fillers, it’s important to do your homework to ensure you’re working with an establishment that’s legally performing the services you seek. DermaTouch RN just celebrated its ten year anniversary, which is in part due to our ethical and legal practices as well as our focus on putting the patient’s needs and safety first.

Did you know that all injectables require a prescription?

When we speak of injectibles, we mean fillers such as Juvederm products (Voluma, Ultra, Ultra Plus), Restylane, Kybella, Sculptra, Radiesse, Botox, and Dysport. These all require a prescription before being injected. Further, certain chemical peels require a prescription.

Who can legally inject with a prescription?

Per our recent blog post, “Who Can Legally Inject Based on Texas Medical Board Rule 197.13?” we shared that, “Per the Texas RULE §193.17, a midlevel practitioner, in addition to a physician, can inject with a written order. A midlevel practitioner is defined as “a physician assistant or advanced practice registered nurse.”

Who should NOT be injecting you?

Licensed Estheticians of any sort are not permitted to inject or use any product or procedure that comes in contact with or penetrates the dermis layer of the skin. In other words, it is illegal for an esthetician to be injecting you, even if delegated by a doctor. Unfortunately, this type of practice happens more often than it should.  Also, an esthetician is not authorized to use lasers for hair removal, teeth whitening, or skin resurfacing.

Medical assistants who are injecting offer another area of concern. “Medical assistant” has no true legal significance in Texas. There are no required training, licensing, or certifications. When direct care is provided by a medical assistant, the patient must be notified of such. Medical assistants are not permitted to write prescriptions and in most cases are prohibited from doing cosmetic laser treatments, fillers, or Botox injections without a prescription. Doctors may be subject to disciplinary action for professional misconduct if they allow a medical assistant to do such things.

How can we ensure legal vs. illegal practices?

Always do your research before having any type of cosmetic treatment performed. Ask for licenses and credentials. If you find that an esthetician or individual is performing injections or services he or she should not be, please contact the Texas Medical Board at 512-305-7030 or 1-800-248-4062 or http://www.tmb.state.tx.us. We want to keep our community and patients safe, first and foremost, and the only way to stop such illegal action from happening is to report it.

Who Legally Can Inject Based on The Texas Medical Board RULE §193.17?

34790755 - wrinkle reduction, the lion

Not all MedSpa and Aesthetic Centers are created equal. In fact, you want to do your homework and have at least a basic understanding of who can perform certain cosmetic procedures in Houston under Texas law. With so many MedSpa and Cosmetic procedures being offered to supplement income for certain health and beauty establishments, you want to make sure you walk through the door of a reputable and safe establishment that knows what they’re doing, and you want to make sure they’re following the legal code of requirements.

So this might seem a bit boring to some, but please bear with us, as it’s important to at least know the basics when it comes to who can or cannot legally inject for cosmetic procedures before any practitioner puts her or his hands on you.

What is the Purpose of Texas Administrative Code RULE §193.17?

As outlined in Texas Medical Board RULE §193.17 – Nonsurgical Medical Cosmetic Procedures

“the purpose is to establish the duties and responsibilities of a physician who performs or who delegates the performance of a nonsurgical medical cosmetic procedure… These procedures can result in complications, and the performance of these procedures is the practice of medicine. This rule shall not be interpreted to allow individuals to perform procedures without a physician or midlevel practitioner being onsite, or a physician being available for emergency consultation or appointment in the event of an adverse outcome.”

Who Can Legally Inject for Cosmetic Procedures in Texas?

Per the Texas RULE §193.17, a midlevel practitioner, in addition to a physician, can inject with a written order. A midlevel practitioner is defined as “a physician assistant or advanced practice registered nurse.” Procedure is defined as “a nonsurgical medical cosmetic procedure, including but not limited to the injection of medication or substances for cosmetic purposes, the administration of colonic irrigations, and the use of prescription medical device for cosmetic purposes.”

In other words, nurses can inject with a written order. A doctor or midlevel practitioner must see the patient and then write an order that is good for a year to allow for future H&P (history and physical examinations)—a review of current prescriptive drugs and over the counter medications of the patient to assure continued safety of treatments rendered.

When is it illegal to inject in Texas?

Per the definitions above, only a physician or midlevel practitioner—a physician assistant or advanced practice registered nurse—can inject for cosmetic procedures such as fillers, Botox, and any procedure that requires numbing injections, and so forth.

However, delivery of prescriptive drugs must be part of the individual’s scope of practice. Anyone who is injecting that falls below the level of a nurse is practicing illegally, even if employed by a physician. It’s tough for the medical board to police all of the physicians who utilize illegal practices unless they are turned in to the medical board by another organization or individual.

Who Do You Prefer for Your Filler or Botox Injections?

All things considered above, having a licensed, qualified physician or registered nurse backed by experience is the preference when it comes to conducting and overseeing cosmetic procedures; and don’t be fooled, in some establishments, the registered nurse has more skill and experience than the physician does when it comes to injections, so ask about experience.

DermaTouch RN has a highly trained staff backed by years of experience in cosmetic procedures, including Founder and Director of Nursing, Renee Moschitto, RN, BSN, and Medical Director, R. Scott Yarish, MD and Board Certified Medical Surgeon. DermaTouch RN’s treatment and care for the patient is unprecedented for MedSpas today, with national recognition from patients.

The Beauty of KYBELLA®

A new FDA-approved injection treatment that’s bringing youthful beauty back

Among the newest products in the arsenal of ageless beauty, KYBELLA® is restoring the appearance of youth to one of the most telling parts of the body – the chin and neck. The nonsurgical sculpting effect of KYBELLA® takes years off the appearance….and profile of both men and women.

KYBELLA, FDA-Approved Solution to Submental Fat in the Chin of Adults.

As we age, not only does our skin lose elasticity but pockets of fat may also accumulate in certain areas of our body.  One of these areas is the chin and neck, giving a double chin appearance to even the leanest among us.  Often resistant to diet and exercise, FDA-approved KYBELLA® injectable treatments are able to dissolve this fatty pocket, known as “submental” fat.

Identical to our own body’s own deoxycholic acid, which helps to absorb and eliminate fats, KYBELLA® works by targeting and destroying these fat cells.

According to a 2015 survey by the American Society for Dermatologic Surgery (ASDS), 67% of people are bothered by the excess fat beneath their chin.

KYBELLA® (deoxycholic acid) is a prescription medicine, the first and only FDA-approved injectable treatment to improve the appearance of moderate to severe fat beneath the chin of adults. Once destroying these fat cells, the area can no longer store or accumulate fat. Based on composite clinician and patient ratings scales, 68.2% and 16% of KYBELLA® -treated subjects had ≥ 1-grade and ≥ 2-grade improvement after final treatment, versus 20.5% and 1.5% of those treated with placebo, respectively (1).

A series of injections are delivered directly to the fatty pocket beneath the chin, destroying fat cells and improving the appearance of moderate to severe convexity or fullness associated with “submental fat” in adults.

KYBELLA®  versus CoolSculpting CoolMini

Unlike the CoolSculpting “CoolMini,” which uses Cryolipolysis (cold therapy) and requires the chin of a patient to be clamped into a small device delivering “arctic level cold” for an hour, KYBELLA®  injections are delivered in a rapid and direct manner to the marked areas, taking less than 30 minutes to complete.

KYBELLA® injection therapy is proving a less invasive alternative to liposuction and surgery to remove double-chin, or submental fat of the chin, in adults. The procedure can accommodate any size patient, unlike the size restrictive CoolMini device.  While most patients see results in just two sessions, size and severity of submental fat may require additional sessions. Though, once results are achieved, patients will not need to address this area again.

Top Five Cosmetic Procedures to Lift and Brighten Your Holiday Season

As the holidays approach and party plans start to take shape, both men and women are scheduling cosmetic procedures to ensure everyone looks their holiday best.  Gift certificates are also proving popular stocking stuffers.

Among the top five pre-holiday procedures individuals seek include:

Simple cosmetic procedures can transform for the holidays.

Simple cosmetic procedures can transform your holidays.

Injectables and Fillers

While among the most popular cosmetic procedures year-round, injectables such as Botox and DySport and fillers such as Juvederm, Restylane, Voluma, Sculptra and the latest in injectable treatments, Kybella, top the list in requested cosmetic procedures in preparation for the holidays.  These simple procedures take little time to perform in the office and produce immediate results – eliminating furroughed brow and forehead lines, reducing the appearance of crows feet, smile and lip lines, as well as lifting brows and subtly plumping lips.

Skin Rejuvenation

Enhanced skin rejuvenation laser therapy helps shed the visible wear of the past year, reinvigorating sun-damaged skin and reducing visibility of age spots, lentigines and facial telangiectasia. Patients with photo-damage and photo-aging often benefit from this type of procedure.

Skin Rejuvenation Laser Therapy Specifically Addresses:

  • Sun damage
  • Wrinkles
  • Photo-aging
  • Lentigines and facial telangiectasia
  • Vascular and pigment irregularities

“Painting” the entire face with the laser, patients typically see clearing of sun damage, wrinkle improvement as collagen forms and overall younger looking skin.  Optimal benefit may require three to eight treatments.

Laser Hair Removal

Hair removal procedures are very popular in preparation for skin baring holiday styles. Utilizing the latest in laser hair removal technology, registered nurses safely remove hair by heating the area at the base of the hair shaft, permanently preventing hair regrowth.

The laser procedure targets the pigment in the hair follicle, which works on either black or brown hair, and must be performed during a specific phase in the hair’s growth cycle (active or anagen phase).  Multiple treatments are required and vary with each individual and by body site.

Skin Tightening with SkinTyte

Skin tightening treatments are among the fastest growing laser procedures in the aesthetic industry. Using infrared energy, SkinTyte is safe for all skin types and can treat any area of the body (face, neck, arms, abdomen, knees), giving skin a firmer and more youthful appearance. There is no need for topical anesthetic, no down time, and no excessive redness. This is truly a lunchtime procedure!

Laser Vein Therapy

A beautiful pair of legs can greatly enhance a holiday dress.  With a revolutionary new laser vein therapy treatment,  spider veins and other distracting veins are quickly and safely eliminated.  Vein removal treatment, including Sclerotherapy and Alscera, effectively eliminates broken capillaries up to 4 mm in diameter on the face and legs as well. Utilizing advanced technology redness and bruising associated with traditional treatments are minimized. This laser vein therapy technology also allows treatment for people of any ethnic origin and skin type, including tanned skin.
